Starting October 1, 2023, Banca Transilvania will change how payments of garnishments to the National Agency for Fiscal Administration (ANAF) are processed for clients with ANAF-imposed garnishments. This change applies to all banks in Romania, following Order of the Ministry of Finance no. 878/2022.
Until now, banks transferred the garnished amounts to ANAF within the legal period of 3 business days from the date the garnishment was imposed. As of October 1, banks must report to ANAF the amounts that can be paid toward garnishments, as follows:
- by 5:00 p.m. on the next banking day after receiving the garnishment order from ANAF;
- by 5:00 p.m. on the next banking day after funds are credited to customers’ accounts.
After the amounts are reported, ANAF will send banks a message (called a payment instruction) requesting the transfer of the amounts that can be paid. On the day the payment instruction is received, the bank will transfer the garnished amounts to ANAF.
Once the amounts available for payment have been reported to ANAF, no transactions that could reduce those amounts may be carried out until the garnishment is paid in full or a garnishment release notice is received.
