1. About these Terms and Conditions

Banca Transilvania S.A (hereinafter referred to as “bank” or “BT”), is a credit institution, Romanian legal entity with registered office in Cluj-Napoca, Cluj - Napoca, Calea Dorobanților Street no. 30-36, postal code 400121, phone 0264 308028, registered at the Trade Register under no. J12/4155/1993, unique code RO 5022670.

BT allows the use of eligible Banca Transilvania cards for payment (hereinafter referred to as “BT cards”) and in Fitbit Pay payment applications (hereinafter referred to as “Fitbit Pay”), Garmin Pay (hereinafter referred to as “Garmin Pay”), Apple Pay (hereinafter referred to as “Apple Pay”) and Google Pay (hereinafter referred to as “Google Pay”). Details regarding eligible BT cards for enrollment and use in Fitbit Pay, Garmin Pay, Apple Pay and Google Pay you find in the dedicated section of the present Terms.

Regarding the solutions Fitbit Pay, Garmin Pay, Apple Pay and Google Pay and about who Fitbit, Garmin, Apple and Google are, you can find details on the website www.fitbit.com, www.garmin.com, www.apple.com, respectively www.google.com, including the privacy policies of these providers, which will govern the processing of your personal data when you use these services.

Please read carefully these "Terms and Conditions" (hereinafter referred to as "Terms”) which governs the registration, activation and use of a BT card in Fitbit Pay, Garmin Pay, Apple Pay and Google Pay.

If there is a discrepancy between the terms of your Fitbit/ Garmin/ Apple/ Google account and these Terms, these terms shall apply to payments made with the BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

2. Limitations of liability

These Terms apply only to the use of BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

These Terms do not apply to the services/products contracted/purchased from the device provider you are using, the mobile phone network, nor from other websites or services belonging to third parties that integrate or allow the provisionFitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. These are third parties to Banca Transilvania and have their own contracts which you comply with when you provide information about yourself, when you use their services or when you visit their websites. Banca Transilvania is not responsible for the legality of the provision/performance of the products/services of the device provider and/or of third parties, nor for the security, accuracy, legality or any other aspect of the respective products/services offered by them.

It is your responsibility to read and understand the provisions of the contracts made available by these third parties before creating, activating, or using your BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

We are not responsible and do not provide any support or assistance for any kind of hardware, software or other third-party products or services (including Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay and your device). If you have questions or problems with a product or service offered by Fitbit/ Garmin/ Apple/ Google or by a third party, please contact the respective supplier/ third party for assistance.

Subject to the General Terms and Conditions of Transilvania Bank applicable to the BT card, you agree that the functions and functionality Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Paycan be improved or updated automatically without any prior notice. At any time we may decide to extend, reduce or suspend the type and/or number of transactions allowed using a BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay or to modify the enrollment process of a BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

3. Banca Transilvania cards eligible for enrollment and use for payment in Fitbit Pay/ Garmin Pay /Apple Pay/ Google Pay

There are eligible BT cards for enrollment and payment use in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay cards issued by Banca Transilvania under the Visa brand, regardless of whether they are debit or credit cards, and regardless of whether they are issued in the name of an individual or corporate client.

Can be enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay both BT cards issued in the name of the cardholder, as well as those of the supplementary cardholder (designated holder), in compliance with the provisions of the section Registration of a BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay from these Terms.

4. Minimum requirements for using BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay applications

To use your BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay you must first own or create an account Fitbit/ Garmin/ Apple/ Google, created as required by Fitbit/ Garmin/ Apple/ Google. Also, you need a compatible device.

You have the possibility to add the same BT card to multiple devices simultaneously. The device provider may impose limitations or restrictions for use Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay and/or may have minimum software and hardware requirements for the compatible device used.

By compatible device is understood any smartwatch, bracelet, smartphone or other type of device that allows making payments by Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. Compatible devices are those presented as such on the Fitbit/ Garmin/ Apple/ Google website.

Do you agree to use the BT card only with a properly equipped device for Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay and comply with all applicable terms and conditions for Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. It is necessary to contact the device supplier directly to find out if your device is compatible for use in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

Before registeringFitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, you need to make sure that only your password/ security details are linked to the BT card you want to use on that device in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. This password/ security details will be used for authorizing transactions made with the BT card issued in the name of the cardholder.

Transilvania Bank is in no way responsible for the requirements of Fitbit/Garmin/Apple/Google or third parties with whom it collaborates for imposing conditions for creating a Fitbit/Garmin/Apple/Google account or compatible devices.

5. Protecting your password / security details

Before entering your BT card details in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay ți se va solicita să îți setezi o parolă/ detalii de securitate, pe care le vei utiliza pentru accesarea Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. In case you know or believe that the password you set has been compromised (e.g. has become known to other people), we recommend that you change it immediately.

Please urgently contact Banca Transilvania at the phone number printed on the back of the BT card, at least in the following situations:

If the BT card you registered in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay is lost or stolen, contact us immediately and notify us that it is registered and in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.
If your device is lost, stolen, or used without your consent.

BT does not assume responsibility for payments made with the BT card enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay until we are notified of the occurrence of an event among those mentioned or until the blocking of this card is requested.

Banca Transilvania does not assume responsibility in the event that the BT card was used for payments through Fitbit Pay /Garmin Pay/ Apple Pay/ Google Pay based on your password that has been used by other people, regardless of whether you communicated it to them or they found out, in any way, without your consent.

To prevent the occurrence of events such as those above, we recommend the following:

keep the device safe and in your possession at all times
keep the security information and device password secure and known only to you
set different passwords/security details for your BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay than those used for the physical BT card.
do not keep BT cards in physical format and/or BT card details together with the device used
If you start using a new device, delete all cards and other personal information from the old device. For details on how to proceed, follow the device provider's instructions.

You undertake to cooperate with Banca Transilvania and/or any competent authority for the prevention of any type of fraud, or for carrying out any investigations that may be conducted in connection with the use of your enrolled BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

Fitbit Pay /Garmin Pay/ Apple Pay/ Google Pay and your device can use certain security features and procedures to protect against unauthorized use of any card. These features and procedures belong exclusively to the device provider. By enrolling the BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay do you agree not to disable any of these security features and to use them to protect all your BT cards enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. Banca Transilvania does not control these security methods and is not responsible for how Fitbit/ Garmin/ Apple/ Google and/ or your device provider uses them.

6. Registering a BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

After setting the password/security details, you will be asked to enter the card details you wish to enroll Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, respectively: the card number, the card expiration date, the cardholder's name, as it is printed on the card, the CVV code, as well as the postal address. All these information (personal data) are necessary to the provider Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay to allow you to use the BT card for payment through this application.

In order to ensure that the person trying to enroll a BT card in Apple Pay/ Google Pay is entitled to request this registration, BT will need to verify the identity of this person. In this regard, in order to complete the enrollment of the BT card in Apple Pay/ Google Pay, after entering the BT card data in this application, it will be necessary that, as the case may be, the cardholder issued in the name of a natural person or the legal representative of the legal entity in whose name the BT card is issued to approve the addition of the card from BT Pay, an application that can be downloaded for free from Google Play, App Store or Huawei AppGallery or to contact the BT Contact Center service, at the phone number 0264308028 or *8028, where a BT representative will request information aimed at ensuring their identification and allowing the setting of the appropriate token for the BT card to be used in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

Token is a virtual representation of the BT card whose registration in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay it is desired. The token is set by BT based on the information about the device used to access the account Fitbit/ Garmin/ Apple/ Google, astfel cum aceste informații îi sunt puse la dispoziție băncii prin intermediul Fitbit/ Garmin/ Apple/ Google and/or third parties with whom he collaborates.

Refusal to provide this information, some of which is personal data, will make it impossible to complete the enrollment of the BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google and its use for payment in the respective application will not be possible.

After completing the registration of the BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, in BT Contact Center, this BT card will be able to be used for payment through Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

7. General conditions of use for payment with BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

Using BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay for the purchase of goods and services is governed by the terms and conditions of the BT card, which are an integral part of the General Business Conditions of Banca Transilvania applicable, as the case may be, to BT customers who are natural persons or legal entities.

You are responsible also for all the uses and transactions made with the BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay by third parties to whom you have voluntarily or involuntarily granted access to your card enrolled in BT Pay, including if these third parties misuse any card or Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

These Terms regulate the access and use of the BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay only between you, as the holder of a BT card, and Banca Transilvania.

Device provider through which payments can be made by Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, as well as of the solution Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay or third parties they collaborate with may have their own terms and conditions and privacy policies. Please be aware that you are subject to those terms and conditions or privacy policies when you use the products and services Fitbit/ Garmin/ Apple/ Google. Banca Transilvania does not assume any responsibility for the way how Fitbit/ Garmin/ Apple/ Google and/or the third parties they collaborate with use the information you provide to them, nor regarding your personal data they process in the context of the services they offer or when you visit their websites.

8. How does Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay work?

a. Making payments with the BT card via Fitbit Pay/Garmin Pay/Apple Pay/Google Pay

Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay allows contactless payments with an enrolled card, at POS terminals installed at various merchants, through the device you use.

By selecting a virtual card and placing the device you are using near a contactless POS terminal at a merchant's location, you authorize the payment for the merchant's products or services.

b. Viewing information and payments made with the BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

Banca Transilvania offers you information about the payments made with your BT card enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay in the ways agreed with BT (e.g., account statement, Internet Banking, at BT units, etc.). This information will be highlighted as payments made with the respective BT card, without indicating that the payments were made through Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay may also give you access to information about payments made with the BT card through Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. About the existence of such a possibility, as well as information regarding this possibility, will be provided to you by Fitbit/ Garmin/ Apple/ Google.

c. Termination of using the BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

Deleting BT card data from Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay does not in any way affect the possibility that this card may continue to be used for payments, according to the Card Usage Conditions, an integral part of BT's General Business Conditions.

BT does not respond if your data and/or your BT card data are used by Fitbit/ Garmin/ Apple/ Google or third parties with whom it collaborates for purposes other than those related to making payments through Fitbit Pay /Garmin Pay /Apple Pay /Google Pay, not even for the period during which you use this BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, not even after the moment of its removal from Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

Can you remove any of the BT cards from Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay at any time, by pressing the corresponding button or link in the application on the device or by calling the number on the back of the BT card. In these circumstances, you authorize Banca Transilvania to continue processing any outstanding transactions on the BT card.

9. Suspension, cancellation and modification of the right to use BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

In addition to any rights to terminate the use of a BT card and/or the card account attached thereto, as established by the General Business Conditions of Banca Transilvania, BT reserves the right to entirely cease offering the possibility to use BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

Also, Banca Transilvania has the right to block, restrict, suspend or terminate the provision of the possibility to use any BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay if these Terms, the General Business Conditions of BT, the conditions stipulated in the card contracts, the terms are violated Fitbit Pay Garmin Pay/ Apple Pay/ Google Pay or if they suspect any fraudulent or inappropriate activity of the card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay or by another payment method.

In addition, in the event that the device and/or application provider Fitbit Pay/ Garmin Pay/ Apple Pay / Google Pay locks, restricts, suspends or interrupts the use of the application Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay and/or modify its functionality, Banca Transilvania will not be liable to its clients who have enrolled their BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay or towards third parties.

10. Taxes

Currently, Banca Transilvania does not charge any fee for using your BT card through Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. In case, in the future, BT decides to charge such fees, it will inform its clients of this information at least two months before starting their application.

Please note, however, that the supplier of your device Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, and/or third parties they collaborate with may charge fees, may impose limitations and restrictions that could affect your use of any BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, such as, but not limited to the use of data or fees related to text messaging imposed by the mobile phone service provider. You are solely responsible for paying these fees and agree to comply with any imposed limitations or restrictions.

11. Interruptions in the functioning of Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

Access, use and maintenance of the virtual BT card depend on Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay and from your internet provider's network. Transilvania Bank does not operate Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay or such networks and has no control over their operations. BT will not be responsible for any situation that interrupts, prevents or otherwise affects the functioning of any BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, precum, dar fără a se limita la indisponibilitatea serviciului Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay or of the internet service, communications, network delays, limitations regarding the internet network coverage, system interruptions.

12. Modification of these Terms

We reserve the right to review these Terms at any time, in accordance with the provisions of the General Terms and Conditions of Transilvania Bank.

We will notify you about changes made to these Terms by e-mail or by another communication method provided in Section XII below. Also, you will be able to view the revised Terms on your device. If you do not agree with the revised Terms, you will have the right to delete any of the BT cards at any time from Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

13. Communication regarding BT cards enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

Regarding the activation and use of the BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, it is possible that Banca Transilvania may need to contact you. For this purpose, any of the cardholder's contact details will be used - correspondence/ home address, e-mail address, phone number, as found in BT's records.

14. Processing and protection of personal data

Banca Transilvania SA processes as an operator the personal data of BT cardholders who wish to complete their enrollment in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay as mentioned within these Terms, respectively for identifying the authorized persons to request this enrollment (details in section VI of these Terms) and/or in case it is necessary to contact them regarding the enrolled BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay (details within sections XI and XII of these Terms).

Personal data processed by Banca Transilvania in the context of making payments with BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay are subject to the provisions General information notes regarding the processing and protection of personal data belonging to BT Clients, integral part of BT Privacy Policies, which you can find on the website www.bancatransilvania.ro or on request at any branch of the bank.

Personal data processed by Fitbit/ Garmin/ Apple/ Google and/or third parties under the conditions of use for payment with BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay are subject to the privacy policy conditions of these entities. Banca Transilvania does not assume any responsibility for how they choose to process the personal data of BT cardholders enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.
