Terms and conditions for using the BT Pay mobile application

1. BT Pay and the agreement to use the application
These terms and conditions for the customer (hereinafter referred to as the “BT pay Terms”) constitute a contract, legally concluded between Banca Transilvania S.A., a credit institution established in Romania, with its registered office in Cluj-Napoca, Calea Dorobantilor, no. 30 - 36, Cluj county, registered with the Trade Register under no. J12/4155/1993, unique code RO 5022670 (hereinafter referred to as “BT” or “bank”) and you (the “customer” or “user”) for the use of BT pay mobile application functionalities (hereinafter referred to as “the application” or “BT pay”) and apply as follows:
A. If you are a major customer (“major user”):
We recommend that you read all of these BT pay Terms before deciding whether to accept them and continue the registration process. If you do not agree with any of the provisions of the BT pay Terms or if you do not want your personal data to be processed as we have brought you to your attention through the information Note on the processing of personal data in BT pay, please do not access, navigate or use the application, nor the software, services, information, materials or other such contained in the application.
If, at any time following your BT PAY (hereinafter referred to as “Application” or “BT Pay”) sign-up, you decide to no longer agree with the herein Terms, please uninstall the application.
BY CLICKING THE „I AGREE” BUTTON BELOW, YOU AGREE WITH THE USE OF BT Pay UNDER THE CONDITIONS STIPULATED IN THE TERMS OF USE AND THE INFORMATION NOTICE REGARDING THE PROCESSING OF PERSONAL DATA IN BT Pay.
B. If you are a minor customer aged between 14 and 18 years (“minor user”, “minor”):
In order to access/use in BT pay the functionalities for minor users (hereinafter “BT pay for minors”), it is necessary that a parent/guardian/legal representative of yours (hereinafter “parent”) is required. To express their agreement in this respect with the bank, by accepting the Terms and conditions of use of BT pay Kiddo functionality (hereinafter “BT pay Kiddo Terms”).
Even if your parent accepts the BT pay Kiddo Terms for you, we recommend that you read these BT pay Terms yourself or – if some words are not clear – with your parent. Please note that the provisions of section 3. What you can do in BT pay from these BT pay Terms, you only apply to operations that may be performed by minors over 14 years of age, as described in the BT pay Kiddo Terms of use. We also mention that the processing of your personal data is carried out according to the information that is prepared specifically for you: Information note on the processing in BT PAY of personal data of users under 14 years of age
If you do not agree with any of the provisions of the BT pay Terms that are also applicable to minor users or if you do not wish to have your personal data processed as we have informed you through the BT pay information Note on the processing of personal data of underage users in 14 years, please do not access, browse or use the application, nor the software, services, information, materials or other such contained in the application.
BY CLICKING ON THE “I AGREE” BUTTON BELOW, YOU AGREE TO THE USE OF BT PAY UNDER THE CONDITIONS MENTIONED IN THE BT PAY TERMS APPLICABLE TO MINORS AND IN THE INFORMATION NOTE REGARDING THE PROCESSING OF PERSONAL DATA OF USERS UNDER 14 YEARS OF AGE IN BT PAY.
C. If you are a minor customer aged between 10 and 14 years unfulfilled ( „ minor user ”, “ minor ” ):
In order to access / use in BT Pay the functionalities for minor users ( further “ BT Pay Kiddo ” ), it is necessary as a parent / guardian/legal representative of ( further “ parent ” ) to express their agreement to the bank, by accepting the Terms and Conditions of Use of BT Pay Kiddo (hereinafter „ BT Pay Kiddo Terms ” ).
Even if your parent accepts the BT Pay Kiddo Terms for you, we recommend that you read these BT Pay Terms as well, alone or – if you are not clear some words – with your parent. We specify that, from the provisions of section 3. What you can do in BT Pay from these BT Pay Terms applies to you only those related to operations that can be performed by minors under 14, as they are described in the head V- BT Pay Kiddo functionalities from the BT Pay Kiddo Terms. We also mention that the processing of your personal data is performed according to the information that is specially prepared for you: Information note on the processing in BT PAY of personal data of minor users under 14 years of age.
If you do not agree with any of the provisions of the BT Pay Terms that are applicable to minor users under 14 or if you do not want your personal data to be processed as I have informed by the Information Note on the processing in BT Pay of personal data of minor users under 14 years of age, please do not access, browse or use the application, nor the software, services, information, materials or the like contained in the application.
BY CLICKING THE BUTTON „I AGREE” BUTTON BELOW, YOU AGREE WITH THE USE OF BT PAY IN CONDITIONS MENTIONED IN BT PAY TERMS APPLICABLE TO MINORS AND IN THE INFORMATION NOTE ON THE PROCESSING IN BT PAY OF THE PERSONAL DATA OF THE MINOR USERS UNDER 14 YEARS.
If you do not agree with any of the provisions of the BT Pay Terms that are applicable to minor users under 14 or if you do not want your personal data to be processed as I have informed by the Information Note on the processing in BT Pay of personal data of minor users under 14 years of age, please do not access, browse or use the application, nor the software, services, information, materials or the like contained in the application.
The terms establish the manner in which you can use in the BT Pay app the cards issued by Banca Transilvania– (hereinafter referred to as “BT Cards”), the cards of other financial institutions from Romania issued under the brand of Visa, Mastercard or Maestro, enrolled in the 3D Secure Service (hereinafter referred to as “non-BT Cards”) and cards issued by BT Direct(hereinafter referred to as “BT Direct Cards”) as well as access to accounts opened in the client's name at Banca Transilvania. The terms are supplemented by the General business conditions of Banca Transilvania applicable to individuals and legal entities (hereinafter referred to as GBC), but also by the official rules of the loyalty programs and of the interest free installment payment programs, with respect to credit cards.
All these documents are available on the bank’s website www.bancatransilvania.ro and www.starbt.ro.
In order to use BT Pay, respectively to view and/or access the services available through the Application, you need to be a client of BT and/or to hold at least one BT debit or credit card issued on behalf of an individual and/or a legal entity.
By signing up to the application, you confirm that you meet the legal requirements and that you are not under any interdiction to use a service similar to BT Pay.BT makes every effort to prevent the inappropriate use of this application and its related facilities. The Bank will monitor how the application is used to verify that it complies with these Terms and that the services are not used in an abusive or illegal manner.
2. How to access BT Pay?
BT Pay is a secure IT app, as a digital wallet, accessible through the mobile phone with Internet connection. The application can be used on iOS and Android operating systems and needs to be installed from dedicated online stores (Google Play Store - for Android, Huawei App Gallery - for Huawei phones without access to Google services, respectively App Store for iOS).
If the bank has specific campaigns that allow users to send personalized links through which the application can be downloaded, BT Pay can be downloaded in this way as well („Invite your friends to BT Pay” campaigns). You will also be redirected to dedicated stores (Google Play Store for Android, Huawei App Gallery - for Huawei phones without access to Google services or App Store for IOS) to download BT Pay app. In certain situations, the Bank may run campaigns with prizes, thus customers who install BT Pay from these links can benefit of special bonuses mentioned in the respective campaign regulations, if they meet the eligibility criteria. The regulations of the campaign can be found on the Banca Transilvania's website, where it can be consulted.
Users can add BT and non-BT Cards and can use the app’s features, described in detail in the guidelines specific to each operating system:
1. User sign-up
The registration of the user will be done by the application by the bank of the strict authentication procedure of the clients, as it is defined in the incident legislation regarding the payment services.
The registration involves the processing of some personal data, as we present in detail in the dedicated information note regarding the processing of personal data for the purpose of identification in BT Pay.
Following the registration made according to this point, depending on the category to which he belongs, i.e. individual bank client or card user, the user will have access to all the functionalities of the application or only to some of them, as mentioned in the specific guides indicated above.
2. Card enrollment
Users can add in BT PAY the following types of cards issued on behalf of a natural person or legal entity:
A. BT cards
Users can add Banca Transilvania cards to BT Pay cards by entering the card data requested in the application.
Cards issued in the name of an individual can be enrolled and used in the BT Pay application even if the user has not taken possession of the physical card.The user can take possession of the physical card either by requesting it by courier, or by picking up the card from the territorial units of Banca Transilvania within the term established in the General Business Conditions of the Bank.
Adding the card in BT Pay app also involves activating it, if the activation was not previously performed at a BT ATM. If the customer has added the card in BT Pay and activated it, and subsequently takes possession of the physical card, it will be necessary to perform the following operations:
a) the card is reissued at maturity - the user must perform with the physical card a first operation of „Change PIN" from the ATM menu - „PIN administration". During this operation you will be asked for the existing pin code of the card and a new pin code, which can be the same as the existing pin code of the card. In the exceptional situation in which the user receives an error at the end of the „Change PIN" operation, he addresses to the bank the request for non-commissioned re-issuance of a new activation code, followed by the standard steps of card activation from ATM BT.
b) the card is newly issued or reissued on request - it is necessary to activate the physical card at the BT ATM and set a pin code for the issued / reissued card.
For mobile phones with Android operating system and built-in NFC technology, for performing contactless payments (NFC), the addition of the card enrollment and its validation leads to the allocation of a payment token (alternative card number) to that card, token that will be associated to the card registered on that phone.
After enrolling the BT card in BT Pay, the user can add the card in Google Pay solution, directly from BT Pay. The user will be subject to specific Terms and Conditions for using BT cards in Google Pay.
For phones with iOS operating system, the validation of the card data takes place, without being assigned a payment token, the token being required only for NFC payments.
After enrolling the card in BT Pay, in order to make NFC payments at the merchants' POS, the user may have the possibility to add it in the Apple Pay solution, directly from the BT Pay application. In this regard, the user will also comply with the Terms and Conditions for using the cards issued by Banca Transilvania in Apple Pay.
By adding the card in the BT Pay app, the user understands that it can be used for financial transactions such as, but not being limited to: contactless payments to merchants, transfers between cards of the same customer, transfers between cards of different customers, based on phone number or via IBAN (in the case of transfers based on the phone number, the user has the possibility to set a main payment card, directly from the card settings, an option that leads to the automatic payment of the amounts to the chosen card, without the need to accept money from SMS), transfers to BT accounts of BT Pay users / to non-BT accounts of Alias Pay users activated at other banks that have joined the SPL (Standardized Proxy Lookup(“participating banks”)) from debit cards issued to BT individuals, receiving of amounts in the account attached to a BT debit card issued on the account of the natural person client holder, based on phone number, from clients of other participating banks (only by activating the Alias Pay * service from BT Pay), initiating interbank transfers (to non-BT accounts) by inserting the payee's phone number (without the need to activate the Alias Pay service), collection in BT cards from non-BT cards, confirmation(approval or rejection, as appropriate) of online payments through BT Pay, payment of utility bills by accessing the Invoice Payment service, viewing the card details: card number and CVV code (the 3-digit code displayed on the reverse card), contactless cash withdrawals, code-based cash withdrawals, card enrollment in the Apple Pay solution(for users with devices having the iOS operating system), card enrollment in Google Pay solution (users with Android operating system devices), activating and setting the Round Up service, issuing or reissuing a debit card, issuing a virtual card, to view the transactions’ history performed with the card (including credit cards), to display the expenses incurred with the card, grouped into categories, to display the benefits related to the enrolled BT card, to view the balance of the account to which the card is attached, in case of credit cards including for: viewing the monthly payment amounts, viewing installment transactions, early repayment of unpaid amounts from monthly installments, setting the automatic payment, on the due date, of the monthly obligations (the minimum and maximum payment amount) from the card holder’s current account, at the crediting of the account to which the credit card is attached with the minimum or maximum payment amount from any card enrolled in the BT Pay application, when applying for shopping offers, services offers and products offers of Banca Transilvania, as well as offers from partners.
The use of these functionalities, which involve debiting or crediting amounts, will be made in the bank account to which the respective card is attached, being the responsibility of its holder.
At the same time, after performing an additional validation by using the code received via SMS, through BT Pay you can access other functionalities of the application, such as: setting daily trading limits on digital and physical cards, temporary blocking and unblocking or permanent blocking of these cards, updating personal data in the bank system.
Also, certain categories of users(as well as, but not limited to: those identified as bank customers, individuals who do not have a STAR Forte credit card) will be able to apply for a credit card of this type with a credit line attached. At the same time, certain categories of users (such as, but not limited to: those identified as clients of the bank, natural persons holding a STAR Forte, STAR Gold, BT Flying Blue Classic, BT Flying Blue Premium credit card) they will be able to apply to increase the credit line on the owned product.
In addition, certain categories of users (such as, but not limited to: those identified as bank customers, individuals, who have a current account with a debit card attached) will be able to apply for a line of credit in the form of an overdraft.
By registering in BT Pay, the user understands that he will have access to his current accounts held in BT and will be able to perform operations as defined in chapter 3 below - "What you can do in BT Pay".
B. BT Direct cards
BT Pay users will be able to add cards issued by BT Direct by manually adding the card data, respectively: card number, first name, expiration date, CVV code (3-digit code on the back of the card).
After enrolling the BT Direct card, the user will be able to use it to perform the following operations: card balance, viewing the history of transactions made with the card, contactless payments to merchants, enrollment of cards in the Apple Pay solution (for users of devices with iOS operating system), enrollment of cards in the Google Pay solution (for device users with Android operating system), confirmation (approval or rejection, as appropriate) of online payments via BT Pay.
C. Non-BT cards
BT Pay users identified as individual customers of the bank and who have at least one BT card enrolled in the application, can also add non-BT cards to BT Pay by manually adding the cardholder data: card number, first name, expiration date, CVV code (the code from 3 digits on the back of the card).
Once the non BT card is added in the BT Pay app, the user can access the Open Banking functionality, that allow the user to visualize some financial info for 90 days, from other financial institution. After this period, the user has to reauthorize the access for a similar period.
If the user accesses the Open Banking functionality, he will be the subject to specific Terms and Conditions.
3. User authentication for accessing and usage of BT Pay
The application can only be used if the phone is secured by password, fingerprint or another security method provided by the phone. When registering in BT PAY, it is checked whether the phone is secured. Afterwards, every time you access the application, it is checked if there is a security on the phone.
The chosen security method will also be used to authorize contactless payments, online payments, ATM withdrawals, transfers, additional card settings, as well as in the case of other options that may require authentication.
If the user has set a security code (PIN code) for BT Pay, it will be used to authenticate and authorize transactions in the application, the user still having the possibility to use the phone security method when paying with the BT application Pay at merchants, without entering the application (if the payment method is set by unlocking the phone). If the user has the function of unlocking the device active by using some biometric data (eg: FaceID, fingerprint), after defining the security code, he will be allowed to activate the biometric data saved in his phone.
You acknowledge and understand that you are responsible for preserving the confidentiality of your authentication details related to the use of the BT Pay application and for taking all reasonable measures to keep such information confidential.
Should you notice the lack, theft, illegal appropriation or unauthorized use of your authentication details, as well as the mobile device that is using BT Pay, you undertake to notify Banca Transilvania without delay. Additionally, you agree to notify Banca Transilvania promptly, without unjustified delays and in the same manner, regarding any other breach of security in connection with the Service of which you become aware.
Banca Transilvania may suspend the use of your Authentication details or of your Account when there is a suspicion that the security thereof is compromised, or they are used in an unauthorized or fraudulent manner.
Banca Transilvania shall inform you in advance or, if not possible in advance, immediately after your Authentication details or your Account has been suspended, by indicating the reasons of such action, except for the situation when the disclosure of such information may compromise the reasonable security measures or may be against the law. Banca Transilvania shall reactivate your Authentication details or your account or shall provide you with new Authentication details or a new Account, within the shortest possible time after removing the causes of the initial suspension.
If you use BT Pay as a legal entity customer, you acknowledge that all officers, employees, agents, representatives and all the other persons who have issued on their behalf a card attached to the account of the legal entity, will be authorized to access the application, to perform payments with it in the application, view the transaction history of the card and the limits set on the card issued on their behalf, temporarily and permanently block the card and access the Offers section.
3. What can you do with BT Pay?
The current features available in the BT Pay application are presented in detail in the dedicated guidelines:

Also, on these web pages you can find details about each feature of BT Pay that the user has the obligation to read and acknowledge.
The current functionalities can be complemented with new ones, transmitted depending on the operating system, in the mentioned guidelines.
The commissions as well as the maximum daily transaction limit for the operations that the user can perform in the BT Pay application are mentioned on the website of Banca Transilvania.
In case of BT credit cards, the automatic payment of the monthly obligations (minimum and maximum payment amount) will be set from the current account of the card holder, payment that will be made on the due date. If the due date is a non-working day, the monthly obligation will be debited on the previous working day. If the user has several current accounts, the first account opened at the bank will be debited.
In case the crediting of the BT card or the setting of the automatic payment option is carried out outside the time interval Monday - Saturday, time schedule 09-19 or on non-working days, the registration of the crediting and of the option will be made in the next working day. Thus, if such an operation takes place on the due date (the 25th of each month) from a non-working day or out of the above-mentioned time interval, the user understands that the monthly payment obligation will not be fulfilled in due time.
The user can pay an online purchase from the mobile phone, selecting directly from the merchant's page the payment method ” BT Pay ”. Later the user chooses the card and confirms the transaction by: biometrics ( FaceID, fingerprint ), or unlock ( password, Code ).
By accessing the Accounts functionality*
The individuals can make transactions on current accounts, regardless of whether or not they have a card attached, including accounts attached to credit cards. The main lei (RON) account of the user will be automatically added after registration in BT Pay.
The "Accounts" section of the BT Pay application offers the user the following functionalities:
- adding accounts in the BT Pay application
- view active accounts and display their balances;
- view cards attached to each account;
- transfers between own accounts;
- making transfers in lei (interbank and intrabank);
- making transfers through Alias Pay;
- view, set and delete recurring payments;
- View transaction history and pending transfers;
- distribution of IBAN;
- foreign exchange (for BT Pay users individuals) - for foreign exchange exceeding the amount of 100,000 EURO/ USD/ GBP versus RON, respectively 25,000 EURO (or equivalent) for the other currency pairs, the Bank offers the possibility to negotiate the exchange rate using alternative channels;
- automatic import of saved beneficiaries into the Neo BT and BT24;
- current account opening in RON or other currency.
The use of the functionalities within the "Accounts" section is subject to the General Business Conditions of Banca Transilvania applicable to the individual client at the time of use.
By activating the Alias Pay* service
The user of the application identified as an individual bank customer, who has at least a BT debit card issued on the personal account added in BT Pay, can activate the Alias Pay service from the application. This service allows him to receive amounts in the account attached to the BT debit card registered for this service from customers of other participating banks, by entering by the customer payer of another participating bank the phone number of the user registered for the Alias Pay service.
The Alias Pay service is offered within the application, but the user can give it up at any time, without affecting the possibility to use the other functionalities of BT Pay. The BT Pay user will be able to stop using the Alias Pay service by deleting his alias previously added in BT Pay.
The use of Alias Pay is subject to the Terms and Conditions applicable to this service and to the conditions for the privacy notice of personal data specific to it.
By activating the Invoice Payments service
The user of the application identified as an individual bank customer, can access the Payments Invoices service from the application.
This allows individual users to pay utility bills. Through this service, Banca Transilvania offers users access to:
a) Payment of invoices to approved providers using one of the following methods:
- Connecting the account related to an approved utility provider;
- Connecting the account to the Pago Application and importing the connected providers from the Pago Application;
- Scanning an invoice received from an approved utility provider, without the previously mentioned configuration;
- Requesting an amount from third party to pay an invoice.
b) Viewing the history of payments made to approved providers;
Use of Invoice Payments is subject to the Terms and Conditions applicable to this service and Information notice regarding the processing of personal data within the Invoice Payments service.
The Invoice Payment Service is offered within the application, but the user may not use it or give up the activated payment options at any time, without affecting the possibility to use the other functionalities of BT Pay.
The BT Pay user will be able to give up the use of the Invoice Payment service by deleting / disconnecting all connected providers and deactivating the existing payment options, in case of their activation.
*By accessing the Round Up functionality
Certain categories of users of the application (such as, but not limited to: those identified as clients of the bank, natural persons, holders of a current account in RON and with at least one own card issued in RON currency, added to BT Pay, will could access the Round Up functionality and they will be able to activate their option on the main current account in Lei. The option is activated at the account level. All payments made with the cards attached to that account will benefit from this option.
Payment transactions accepted for the Round-Up service are:
- Payment with debit card or through wallet type applications made at a POS;
- Payments made online using the debit card;
Payments made from the overdraft, as well as transfers made from the current account (scheduled or not), cash withdrawals with the debit card, bill payments at the ATM will not be rounded. Also, payments made with the BTDirect card and payments with the BT meal ticket card will not be rounded.
The minimum intangible balance is 30 lei, which means that rounding will not be possible if the accounting balance of the source account is less than or equal to 30 lei.
The use of this service is subject to the Terms and Conditions applicable to it.
By accessing the Savings functionality
The application user identified as a client of the bank, natural person, account holder, who has set a PIN (security code), can access the "Savings" functionality from BT Pay.
Within the Savings functionality, the user can view the savings products held at Banca Transilvania, can set up other deposits/savings accounts available in the bank's offer, respectively can close them through the application.
The establishment of deposits/savings accounts is subject to the Terms and Conditions applicable to each of these products, as follows:
- Terms and conditions related to classic deposits set up in BT Pay
- Terms and accounts related to savings accounts (Lei/Euro) set up in BT Pay
*By accessing the credit card service
Certain categories of users of the application (such as, but not limited to: those identified as customers of the bank individuals, residents, who have a BT debit card issued on the personal account added to BT Pay, except for the BT meal card), and who do not have a card STAR Forte credit card issued as a holder, can view in the application the credit card application option. This service allows the user to initiate an application for a STAR Forte credit card and, if the criteria in the BT credit policies are met, to obtain this card and the related credit line.
The credit card granting option is offered within the application, but the user is not obliged to access it, not accessing this option does not affect the user's right to use the other functionalities of BT Pay.
The use of this functionality involves the processing of personal data as specified inPrivacy Notice on the processing of personal data for obtaining an online BT credit card exclusively.
*By accessing the credit line increase option
Certain categories of users of the application (such as, but not limited to: those identified as clients of the bank, natural persons, residents, who have a BT debit card issued on the personal account added to BT Pay, with the exception of the BT table card ), who hold a STAR Forte, STAR Gold, BT Flying Blue Classic, BT Flying Blue Premium credit card issued as a holder, can view the option to increase the credit line for the owned product in the application. This service allows the user to initiate a request for a credit line increase and, in the situation where the criteria from the BT credit policies are met, to obtain an increase in the credit line related to the product he owns.
The option to increase the credit line is offered within the application, but the user is not obliged to access it, not accessing this option does not affect the user's right to use the other functionalities of BT Pay.
The use of this functionality involves the processing of personal data as specified in Privacy Notice on the processing of personal data for obtaining an online BT credit card exclusively.
*By accessing the option of granting an overdraft credit line / a money reserve
Certain categories of users of the application (such as, but not limited to, those identified as bank customers, individuals, residents, who have a BT debit card issued on the personal account added to BT Pay, except for the BT meal card), can view the application option for overdraft. This service allows the user to initiate an overdraft grant request and, if the grant criteria in the BT credit policies are met, can obtain the overdraft.
The option to grant an overdraft account is offered within the application, but the user is not obliged to access it. Failure to access this option does not affect the user's right to use other features of BT Pay.
The use of this functionality involves the processing of personal data as specified inInformation note on the processing of personal data for obtaining an online overdraft exclusively.
*By accessing the RCA Insurance issue option
From the BT Pay application, the application user designated as a bank client can access the "RCA Insurance" option. With this feature, the consumer may view RCA insurance offers that are appropriate for his vehicle and buy RCA insurance straight from BT Pay. The client will receive a copy of the policy through email when it is issued, however the customer may always resend the policy by email from the application.
At the same time, the client will receive two reminders about the insurance policy's expiration: one 30 days before the insurance expiration date and another seven days before.
The RCA insurance policy is issued subject to the Terms and Conditions that apply to this service as well as the Personal Data Processing Conditions that are particular to it.
By accessing the "Travel Insurance" option
The "Travel insurance" option can be accessed from the BT Pay application by the application user who has been identified as a natural person bank client. If a number of requirements are satisfied, the consumer can use this option to view the travel insurance offers that are best for him based on a needs analysis and can buy the travel insurance directly from BT Pay. The client will get the policy and the full set of documentation related to this insurance to the email address provided after the policy has been issued.
*By accessing the "Travel Insurance" option
The "Travel insurance" option can be accessed from the BT Pay application by the application user who has been identified as a natural person bank client. If a number of requirements are satisfied, the consumer can use this option to view the travel insurance offers that are best for him based on a needs analysis and can buy the travel insurance directly from BT Pay. The client will get the policy and the full set of documentation related to this insurance to the email address provided after the policy has been issued.
*By accessing the BT pay Kiddo option
The user of the application identified as a client of the individual bank can activate from the BTPay application the BT pay Kiddo option, through which he can give permission to the minor child, aged between 14 and 18 years, to use the BT pay application. The use of this functionality is subject to the Terms and conditions applicable to it.
By accessing the BT Pay Kiddo option 10-14 years unfulfilled
The user of the application identified as a customer of the individual bank can activate from the BT Pay application the BT Pay Kiddo option, through which he can offer the permission of the minor child aged between 10 and 14 years unfulfilled, use the BT Pay application. The use of this functionality is subject to the Terms and Conditions applicable to it. If at any time after registration in BT PAY you decide that you no longer agree to these BT Pay Terms, please uninstall the application.*By accessing the Transfer your money to BT option
The user of the application, a client of the bank, can access the "Transfer your money to BT" option, through which he can transfer, with the desired frequency, the income or other amounts that are in the account to which a non-BT card is attached enrolled in BT Pay, in an account to which a BT card already existing in the wallet is attached.
Meanwhile, BT individual customers, BT Pay users, will be able to identify themselves via the BT Pay Application, in a call launched to/ from Call Center, installed on the phone number presented to the bank. Customers who choose this way of identification will receive a push notice from BT Pay, from which they will be able to accept or decline the identification, or they will be able to identify themselves via the technique of unlocking the phone.
*By using the identification option in BT Pay
Individual BT clients, users of BT Pay, will have the opportunity to be identified through the Application installed on the declared telephone number during a telephone call initiated to/from the Call Center or, as the case may be, in the case of operations carried out in BT units the bank. Customers who opt for such identification will receive a push notification sent to BT Pay, from where they will be able to accept/reject the identification, respectively they will be able to identify themselves using the phone unlock method/security code used for BT Pay.
4. Declarations and guarantees
When signing up to BT Pay, you declare and warrant that:
- you have full right, authority and capacity to access and use the application (valid only for major users).;
- you are the owner of the cards issued by Banca Transilvania and / or issued by other financial institutions from Romania which are to be enrolled in BT Pay;
- that you are obliged to maintain a method of unlocking the phone while the BT Pay application is installed on the phone;
- you shall not disclose the phone unlock password/ security code to any third party, because of the risk for your cards to be used for payment by other persons as a result of such disclosure. You are solely responsible for preserving the confidentiality and for safekeeping your personal details inserted in the BT Pay application, as well as your phone unlock password. Additionally, you are responsible for any kind of activity occurring on your account;
- if you have chosen to activate biometric data for authentication in BT Pay, you are obliged not to allow the registration of biometric data - fingerprints or face ID - belonging to other people on the phone, considering that, in this case, accessing the application, respectively authorizing transactions it could be done with any of the biometric data added to the phone;
- you undertake to notify us promptly regarding any unauthorized use of your account or any security breach affecting your account, of which you become aware or which you should reasonably suspect.
- The user assumes full responsibility for those cases where the phone number introduced / selected by the user in BT Pay or the IBAN code introduced, to which the user ordered the bank to transfer / request money amounts is wrong or does not belong to the person to whom the user intends to transfer / request those respective amounts;
- The user assumes full responsibility for those cases in which the phone number entered / selected by the user in BT Pay, to which the user ordered the bank to send the code required for cardless cash withdrawals, it does not belong to the person to which you intended to transmit it or if this code was subsequently transmitted by the addressee to another person;
- The user assumes full responsibility for registering his own cards (BT or non-BT) in the BT Pay application, for making any transactions with them (including authentication / rejection of online payments), regardless of the device on which the app is registered and you authorized the registration of this card is installed;
- The user assumes full responsibility for connecting to Open Banking functionality, which allows to display for 90 days, some financial information of accounts opened with another financial institution: IBAN, balance and transaction history from the payment accounts. Also the user assumes the proper association of non BT card the corresponding account.
- The user assumes full responsibility for the distribution of links and / or promotional messages of BT Pay campaigns and guarantee to the bank that will not use these distributions abusively;
- Do not communicate to third parties the OTP code received on your phone number for adding the card in BT Pay and / or unlocking various functionalities, implicitly the permission for authorization of online payments;
- you agree to tell us as soon as you become aware of any lack, loss, unauthorized access, or theft of the mobile phone on which the BT Pay application is installed. In the event that you fail to comply with the above obligation, you accept full responsibility for any and all operations that unauthorized persons may perform through the Application or as a result of the identification made through the Application installed on the bank's declared telephone number in a call to/ from the BT call center, including accessing any banking information or updating data.
- that you will not abusively use the BT Pay functionality that allows you to make transfers based on phone number to non-BT accounts (interbank transfers) opened at participating banks in order to take over information that is not intended to initiate a payment;
- uninstall the application in case the phone you originally installed will no longer belong to you or you will no longer use it;
- you shall not counterfeit or provide inaccurate information regarding your identity or your intentions concerning the application;
- you shall not send, disseminate or provide any information or materials which are totally or partially illegal, false, fraudulent, inappropriate or offensive, or which contravene the public order and morality standards;
- you shall assure and maintain physical and logical phone security, according to manufacturer recommendations and good practices;
- you shall update the operating system according to manufacturer recommendations and you shall use only the official manufacturer operating system;
- you shall not inhibit security protection of operating system recommended by manufacturer;
- you will install BT Pay only from dedicated stores- Google Play Store, Huawei App Gallery and App Store, published by Banca Transilvania;
- you will not install applications from unofficial sources, because these might compromise BT Pay security;
- to ensure that any data introduced in the application is correct and complete;
- you shall not violate any right stipulated by law, any property rights, any intangible rights, any right regarding confidentiality or the protection of personal data belonging to other persons;
- you shall not use the content of the application to resell, distribute or use the provided services;
- you shall not distribute the offers available in the BT Pay application;
- that you will not use the functionalities offered within the application abusively and/or in bad faith and/or for fraudulent purposes;
- you shall access the accounts open in your name, as user of the physical activity tracking apps, and you will respect the confidentiality of this information;
- you confirm that you have read the Terms herein, you agree with them and with the use of the personal data mentioned in the Information Notice regarding the use of personal data under BT Pay, in order to be able to use the application;
- you shall not violate any law or regulation applicable in your domicile country by using the application, the responsibility for complying with all local laws and regulations in force belonging to yourselves exclusively.
5. Cessation or change in the use of BT Pay
The cessation of BT Pay use may occur in the following situations:
a) at the user’s initiative, by uninstalling the application on your mobile device.
b) at the initiative of the bank, in case of violation by the user of the provisions of these BT Pay Terms;
c) the termination of the business relationship between the client and the Bank.
Moreover, we are entitled to suspend or change BT Pay immediately and for any reason whatsoever, including the situation when the application undergoes service or maintenance works. We may periodically add new functions and we are not obliged to provide any particular function via BT Pay. We may withdraw your right to use BT Pay, case in which you shall be duly notified 30 days in advance.
We are entitled to change the Terms herein at any time, the amended Terms being published by means of the BT Pay application. In such circumstance, the users shall be notified via the application, and / or by another method of communication using the contact data found in the bank's records. From the moment of notification or, as the case may be, from the date indicated in the notification as the one from which these Terms are modified, the updated version of them will be applicable to all users.
If you do not agree with the revised Terms, you can uninstall BT Pay anytime, with immediate effect.
In cases in which there will be implemented additional services in the application, these services will be subject to the same terms and conditions presented in these clauses, only if they do not require different conditions.
6. Intellectual property rights
The user expressly declares having acknowledged that the entire graphic design, the application content and the audiovisual materials accessed represent the property of the Bank. The information and the graphic elements of other entities, which are owned by the bank’s partners, are excepted.
The user agrees that any software used in connection with the services provided via the application contains confidential data subject to property right and protected by the laws on intellectual and industrial property rights, as well as by any other applicable laws.
The user undertakes not to duplicate, copy, sell or use for profit in part or in full the services, information and / or audiovisual materials available as a result of using the application.
The user is forbidden to change, copy, lease, assign, lend, sell, disseminate or derive materials based on the services or programs available in the application.
7. Aspects beyond our responsibility
We provide the BT Pay application for your personal use exclusively. BT Pay services are not compatible with all mobile devices.
You hereby agree that the application might not operate free of errors or on a continuous basis and that certain flaws might not be eliminated promptly upon their occurrence.
The user is solely responsible for the use of the application. Banca Transilvania cannot be held liable for the consequences of the personal or third-party use of the application, for the costs resulting from the application use or from the access of third parties to certain personal and / or confidential information or data via the application. In order to limit the potential damage caused by the application use by third parties, Banca Transilvania recommends that you do not hand over / lend your phone to another person, that you do not disclose your device unlock method/ security code used for BT Pay and that you do not give your card to other persons.
Banca Transilvania cannot control the operating system on your mobile device. Therefore, Banca Transilvania is not liable for any damage to your mobile phone, including without limitation any security breach caused by viruses, errors, frauds, forgery, omission, disruption, malfunction, delayed operation or transmission, computer network breakdown or any other technical failure with effects upon your device.
Therefore, we shall not be liable for any loss or damage which could not be reasonably foreseen by us or by yourselves at the date when you started using BT Pay, or which is beyond our control.
Moreover, we shall not be responsible for any of the following:
- any loss or damage (moral or material) resulting from the inobservance of the Terms herein;
- in case of the persons whose phone numbers have been entered in your application by yourself for making transfers based on the telephone number or for transmitting the necessary code for the withdrawal of cash without a card, denounce the use of the contact information that belongs to them
- the content or services / discounts provided by STAR partners through the offers published in BT Pay; unavailability or non-updating of the offers;
- the association of non BT card added in the app to the corresponding account, in Open Banking functionality;
- the accuracy of the information in the app, the availability or reliability of any information or content made available by any third parties, such as physical activity tracking applications. Consequently, we are not responsible in any way for any damage or losses caused or considered to be caused by or in connection with the usage of or addiction to such third-party apps;
- health issues that might occur due to using these devices and applications or resulted from the physical activity undertaken by the user;
- any loss or corruption of your information content or of other personal data, unless such loss or corruption is caused by us or is under our reasonable control. Moreover, we inform you that Banca Transilvania is not liable to yourselves and / or to other third parties for any direct or indirect damage, including without limitation profit losses, unachieved gains and / or loss of business opportunities or any other similar losses that you may incur for not using the application and the services or due to the inadequate service quality.
8. Applicable law
The terms and conditions of using the BT Pay application, as presented in this document, are and will be governed and interpreted in accordance with the Romanian law.
In the event of any litigation / disagreement regarding the use of the application, we shall endeavor to settle such litigation in an amicable manner, the negotiations in this respect being governed by good faith principles.
All litigations shall be settled by the competent courts in Cluj-Napoca, unless the applicable legislation stipulates an exclusive jurisdiction in relation to yourselves.
Specific provisions for US users of BT Pay
If you are a US user of the BT Pay application (user whose identity documents used in the identification/authentication process through the application were issued by the competent authorities in the United States of America), by accepting these Terms and Conditions you agree as:
(i) any complaints/ dissatisfaction with the processing of your personal data (such as, but not limited to, biometric data) by the provider/third party provider of identity verification services whose solutions are used in within the previously mentioned application (hereafter referred to as Onfido for the purpose of this clause) will NOT be the subject of any litigation/collective actions submitted for settlement to the courts in the territory of the United States of America;
(ii) any complaints/ dissatisfaction with the processing of your personal data mentioned in point (i) will be subject to an individual arbitration procedure;
(iii) the settlement through arbitration of any complaints/ dissatisfaction with the processing of your personal data mentioned in point (i) according to the provisions of point (ii) will be carried out in strict accordance with the arbitration procedure established by the supplier/third party provider of the identity verification services (Onfido) as they will be communicated to you.

10. Force majeure and unforeseeable circumstances
Banca Transilvania shall not be liable to the user for the failure to fulfill any obligation as a result of a force majeure event / unforeseeable circumstances and generally any event beyond its control, as well as for the functioning and connectivity of other national or international networks and their related activities and operations.
A force majeure event / unforeseeable circumstance includes but is not limited to: war (declared or not), armed conflict, revolution, insurrection, military or terrorist actions or threats, sabotage, civil movements, strikes or other labor actions, laws, regulations, decisions or directives, natural disasters, earthquake, fire, explosion, solar or meteorological disturbances, public emergencies, or any other event beyond the parties’ control.
